1. AGREEMENT TO TERMS

These Terms and Conditions ("Terms"), along with any applicable Service Agreement, constitute a legally binding agreement between the Client and Flownetic AI, operated by Xolo Go OÜ - Dragan Babić ("Flownetic", "we", "us"). By accessing and using our website (https://aiflownetic.com) or services ("Services"), you agree to be bound by these Terms. We may update these Terms at any time. Continued use of our website or Services constitutes acceptance of any changes.

3. SERVICES AND CLIENT ACCESS

Flownetic grants Clients a limited, non-transferable, non-exclusive license to use our lead generation, automation, CRM integration, and AI services for internal business purposes only. Clients are responsible for ensuring the security and proper use of login credentials.

4. CLIENT DATA AND PRIVACY

Clients retain all rights to their data, including email addresses, phone numbers, and CRM entries. By using our services, you grant us a license to use this data solely to deliver Services. We follow GDPR-compliant practices. See our Privacy Policy for more details.

5. THIRD-PARTY INTEGRATIONS

Flownetic integrates with OpenAI, Stripe, Make.com, Calendly, and other tools. By using our Services, you agree to the terms of these third-party providers.

6. REPRESENTATIONS AND RESPONSIBILITIES

You represent that:

All data shared with us is accurate and compliant with relevant data laws (e.g., GDPR, UAE and UK data regulations).

You have obtained user consent where required.

You will not use our services for illegal or unethical purposes.

7. INTELLECTUAL PROPERTY

All software, content, and branding on our website are owned by Flownetic. You may not copy, distribute, or modify our intellectual property without our written consent.

8. CONFIDENTIALITY

Both parties agree to protect confidential information disclosed during the partnership for a period of three years. This includes business strategies, data, and operational methods.

9. CANCELLATION AND TERMINATION

Clients may cancel services with written notice. Fees for work completed up to the termination date are non-refundable.

10. LIMITATION OF LIABILITY

We provide our Services "as is" without guarantees. To the extent permitted by law, Flownetic will not be liable for indirect damages or lost profits. Our total liability will not exceed the amount paid by the Client in the past 6 months.

11. DISPUTE RESOLUTION

Any disputes will first be resolved through informal negotiation. If unresolved, disputes will be subject to arbitration under Estonian law, with jurisdiction in Tartu, Estonia.

12. PROHIBITED USES

Clients may not:

Use the Services for spam or unsolicited outreach.

Reverse engineer or resell the software.

Introduce malware or malicious code.

Harass or abuse team members or other users.

13. DATA SECURITY

We implement security measures to protect your data. However, we are not liable for data loss beyond our reasonable control. You are encouraged to keep backups of all data submitted to our platform.

14. ELECTRONIC COMMUNICATION

By using Flownetic, you consent to receiving communications electronically, including agreements, invoices, and updates.

15. FORCE MAJEURE

Flownetic is not liable for delays or service interruptions due to circumstances beyond our control, including acts of God, internet outages, or governmental restrictions.

16. MODIFICATIONS

We reserve the right to modify or discontinue Services at any time. We will notify clients in advance when possible.

17. GOVERNING LAW

These Terms are governed by the laws of Estonia. Any legal claims must be resolved in the courts of Tartu, Estonia.
